These Terms of Service ("Terms") govern your access to and use of Clock That Care™ (the "Platform"), a digital membership platform operated by Debra Jenkins ("we", "us", "our"). By creating an account, purchasing a membership, or otherwise using the Platform, you ("Member" or "you") agree to these Terms.
1. Eligibility & Account
You must be at least 18 years old to purchase a membership, or have permission from a parent or guardian. You are responsible for the accuracy of your information and for keeping your password confidential. You are responsible for all activity under your account.
2. Payment Processing (Merchant of Record)
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms.
3. Membership
- Clock That Care Basic grants access to members-only educational content while your subscription is active.
- Subscriptions renew automatically until canceled through your account or the Paddle customer portal.
- Canceling stops future renewals; you retain access until the end of the current billing period.
4. Acceptable Use
You agree not to misuse the Platform. In particular, you may not:
- Copy, record, screenshot for redistribution, upload, reproduce, resell, or share Clock That Care content.
- Share your login credentials with anyone else.
- Attempt to reverse-engineer, scrape, probe, or interfere with the Platform's security or availability.
- Use the Platform in violation of any law, or to infringe intellectual property or privacy rights.
- Upload malware, spam, or abusive content.
5. Intellectual Property
All Platform content — including videos, lessons, PDFs, downloads, graphics, journal prompts, games, training materials, educational resources, website content, and branding — is owned by Clock That Care and protected by copyright and other laws. Membership grants you a limited, non-exclusive, non-transferable, revocable license to access the content for your own personal, non-commercial learning. All other rights are reserved. 6. Educational Purpose
Clock That Care provides educational resources only. It does not provide medical advice, diagnosis, or treatment. See our Educational Disclaimer.
7. Member Contributions
If you post content on the Platform (stories, journal shares, Ask Debbie submissions, comments), you retain ownership but grant us a non-exclusive, worldwide, royalty-free license to host, display, and moderate that content in connection with the Platform. You are responsible for the content you post.
8. Suspension & Termination
We may suspend or terminate your account for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may cancel your membership at any time. Sections that by nature should survive termination (IP, disclaimers, liability) will do so.
9. Warranties & Disclaimers
The Platform is provided "as is" and "as available." We do not warrant uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Limitation of Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Platform will not exceed the fees you paid in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date and, for material changes, require you to re-accept the updated Terms and Privacy Policy before continuing to use the Platform.
12. Governing Law
These Terms are governed by the laws of the United States and the state of the operator's residence, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts of that jurisdiction, except where prohibited by applicable law.
